Irvine, CA- On behalf of its client Greenlight Financial Services, Inc., (“Greenlight Financial”) the firm prevailed in a 2-week jury trial in the Orange County Superior Court of California on a breach of contract claim against the defendant Internet Brands, Inc. (“Internet Brands”). “We are very pleased with the outcome of trial for our client and that the jury decided to hold Internet Brands accountable for their actions,” states co-lead trial counsel John D. Tran. “The case involved technical issues such as lead aggregate sites, and internet traffic diversion which made the case interesting to try before a jury.” The Rhema Law trial team consisted of John D. Tran, William L. Buus and Rosalind T. Ong.
Greenlight Financial claimed that Internet Brands breached a settlement agreement entered into by both parties resolving prior litigation involving claims of trademark infringement of the “Greenlight” mark by Internet Brands. At trial, the firm argued that Internet Brands failed to perform its obligations under the prior settlement agreement which caused damages in the form of lost profits to Greenlight Financial.
The jury returned a verdict for breach of contract, breach of the covenant of good faith and fair dealing and awarded lost profit damages in the amount of nearly $1 million dollars (including recovery of attorneys’ fees and costs).
